Terms of Service

Agreement to Terms

These Terms of Service (the Terms) govern your access to and use of indiesaasforge.com and the related services provided by Indies SaaS Forge. By using the Services, you agree to be bound by these Terms. If you do not agree, do not access or use the Services. The Services are offered to users worldwide, subject to applicable laws.

Eligibility

These Terms apply to individuals and entities who can form a binding contract under applicable law. By using the Services, you represent that you have the capacity to form a contract and that you will comply with these Terms. If you are using the Services on behalf of an organization, you warrant that you have the authority to bind that organization to these Terms.

Definitions

  • Services means the indiesaasforge.com platform, including any software, APIs, tools, and services provided by Indies SaaS Forge.
  • User Content means any data, text, files, or other materials uploaded by you or your permitted users through the Services.
  • Confidential Information means non public information disclosed by the Company to you in connection with the Services.

Intellectual Property Rights

All content, software, code, databases, architecture, and related materials on indiesaasforge.com are owned by Indies SaaS Forge or its licensors. Subject to these Terms, we grant you a limited, non exclusive, non transferable, non sublicensable license to access and use the Services for your internal business purposes only.

Ownership of User Content

You retain ownership of your User Content. By uploading or transmitting User Content through the Services, you grant Indies SaaS Forge a worldwide, non exclusive license to host, store, reproduce, modify, create derivative works, and display that content as necessary to provide the Services. You represent that you have all rights needed to grant this license and that such content does not violate any law or third party rights.

User Restrictions and Acceptable Use

Prohibited Conduct

You must not:

  • Use the Services for illegal activities or to facilitate wrongdoing, including unauthorized access, exploitation of vulnerabilities, distribution of malware, or plans to cause harm.
  • Attempt to gain unauthorized access to any system, account, or data.
  • Interfere with, disrupt, or degrade the Services or the networks and services connected to the Services.
  • Reverse engineer, decompile, disassemble, or attempt to derive source code from the Services, except to the extent required by applicable law that cannot be waived.
  • Use the Services to infringe intellectual property rights, privacy rights, or any other rights of third parties.
  • Reproduce, copy, or redistribute materials from the Services except as permitted by these Terms or with our prior written consent.

Responsible and Authorized Use

Where applicable, you may use the Services for security testing, vulnerability assessment, or related activities only if you have written authorization from the owner of the system being tested and you comply with all applicable laws, regulatory requirements, and industry standards. If you identify a vulnerability, you should follow responsible disclosure practices and notify the owner or us as appropriate. Do not publicly disclose vulnerabilities in a manner that could facilitate exploitation without providing a reasonable time to remediate.

Data and Privacy

Your use of the Services is governed by our Privacy Policy, located at indiesaasforge.com/privacy. You are responsible for the security of your credentials and for any activity conducted through your account.

Limitation of Liability

To the maximum extent permitted by law, Indies SaaS Forge and its affiliates, officers, directors, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to these Terms or your use of the Services, including but not limited to loss of profits, data, or goodwill, even if advised of the possibility of such damages. Our total liability for any and all claims under these Terms shall not exceed the greater of (a) the amounts paid by you to access the specific Services giving rise to the claim, or (b) USD 100.

Disclaimers

The Services are provided on an as is and as available basis. Use of the Services is at your own risk. The Company makes no warranties, express or implied, including without limitation, warranties of merchantability, fitness for a particular purpose, non infringement, or that the Services will be uninterrupted or error free. The Company does not warrant that any vulnerabilities will be identified or that any security risks will be mitigated. Nothing in these Terms constitutes legal, financial, or professional advice.

Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of California, United States. Any disputes arising out of or relating to these Terms or the Services shall be resolved exclusively in the state or federal courts located in San Francisco, California, and you consent to the personal jurisdiction of such courts. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Changes to Terms

We may modify these Terms from time to time. When we make material changes, we will provide notice by posting the updated Terms on indiesaasforge.com and updating the Last Updated date. Your continued use of the Services after the effective date of the updated Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must discontinue use of the Services.
